Indiana Consumer Data Protection Act (ICDPA) Reference Guide

Indiana residents can opt out of targeted advertising, personal-data sales and certain profiling. For a covered company, the privacy choice needs to reach the tracking scripts and vendors that carry out those activities.

Indiana’s act took effect January 1, 2026. This guide explains its coverage, rights and technical checks while keeping legal interpretation with the organization’s privacy counsel.

What is the Indiana Consumer Data Protection Act?

The Indiana Consumer Data Protection Act (ICDPA), Indiana Code article 24-15, took effect January 1, 2026. Qualifying residents can access, correct, delete and obtain eligible data, and opt out of targeted advertising, sale and profiling tied to significant decisions. Covered controllers also have notice, security, sensitive-data, processor and assessment duties. Indiana General Assembly: current Title 24 Indiana Attorney General: Consumer Bill of Rights

A website scan reports what tags, cookies and requests do after a choice. It cannot determine from a network call alone whether the company meets an Indiana threshold, whether a transfer is a statutory sale, or whether an exemption applies. Indiana Code: article 24-15, chapters 1–2

01 / APPLICABILITY

Coverage depends on consumers and revenue.

Indiana’s act covers a person doing business in the state or offering products or services targeted to residents if, in a calendar year, it controls or processes personal data of at least 100,000 consumers. The second route is at least 25,000 consumers and more than 50% of gross revenue from selling personal data. Indiana Code: IC 24-15-2-1 Indiana Attorney General: coverage FAQ

Government bodies, certain financial and health entities, nonprofits, higher education and public utilities are among the stated exceptions. Some data types are separately excluded. Counsel should assess the specific organization and transfer. Indiana Code: IC 24-15-2

Website visits are only one input

The volume is based on statutory consumers in the relevant calendar year. Pageviews cannot establish consumer count or the share of revenue from sales.

02 / RIGHTS AND DUTIES

Three opt-out purposes sit alongside access rights.

Indiana residents may confirm processing, receive eligible data, correct certain provided data, delete personal data and obtain a portable copy. They may opt out of targeted advertising, sale, and profiling used for decisions with legal or similarly significant effects. Controllers generally respond within 45 days and may extend by 45 days if necessary with timely notice. Indiana Code: IC 24-15-3 Indiana Attorney General: rights and timing

A controller needs consent to process sensitive data, with distinct rules for known children, and must provide a meaningful privacy notice, reasonable security and applicable processor contracts and assessments. Legal counsel decides how a particular dataset and recipient should be classified. Indiana Code: IC 24-15-4–5 Indiana Attorney General: sensitive data

Resident rights

  • Access, correct and delete eligible data
  • Receive data in portable form
  • Opt out of targeted advertising
  • Opt out of a statutory sale
  • Opt out of certain consequential profiling

  • Explain processing and opt-out methods
  • Record and honor eligible requests
  • Get consent for sensitive data
  • Secure data and govern vendors
  • Assess specified high-risk activities

03 / WEBSITE TRACKING

A surviving tag needs context and a purpose.

Indiana’s sale definition concerns exchange of personal data for monetary consideration, with exceptions for processors, affiliates and other circumstances. Targeted advertising is a separate opt-out purpose. A pixel may fall within targeted advertising even where a particular transfer is not a monetary sale. Indiana Code: definitions and consumer rights Indiana Attorney General: opt-out guide

Inventory every tag, cookie and endpoint, including scripts coded directly into the site. Record what an eligible opt-out changes, and give the legal team the recipient and contract information needed to interpret the data flow.

Test every route that sends data

  1. List client-side and server-side tags, direct scripts and cookies.

  2. Classify targeted advertising, sale and processor activity.

  3. Submit the site’s actual opt-out method.

  4. Observe requests and storage after the choice.

  5. Repair rules that let classified traffic continue.

  6. Retest and document the difference.

04 / OPT-OUT SIGNALS

Check GPC and the direct request separately.

The ICDPA gives consumers direct opt-out rights and requires a secure, reliable way to submit requests. Its text does not expressly require a universal GPC browser signal to be accepted as every Indiana opt-out. A business serving several states may still recognize GPC under other laws or a shared privacy architecture. Indiana Code: IC 24-15-3–4 Indiana Attorney General: how to exercise rights

Test consent rejection and GPC in separate browser sessions, then compare the results. For Indiana-specific evidence, run the site’s own consumer request route too, then compare which classified marketing and sale flows continue.

  1. Indiana consumer opts out
  2. Site records the request
  3. Tags and vendors receive it
  4. Affected flows respond
  5. Post-choice traffic is checked

Evidence to preserve

  • Which route was offered to the visitor?
  • Did the choice reach hard-coded and Tag Manager scripts?
  • What did the browser request before and after?
  • Were server-side routes included?
  • Which use and recipient does each continued request represent?

05 / ENFORCEMENT

The Attorney General gives notice and a cure window.

The Indiana Attorney General has exclusive ICDPA enforcement authority. Before an enforcement action, the statute provides 30 days’ written notice identifying alleged violations and an opportunity to cure with the required assurance. The Attorney General may seek an injunction and civil penalties up to $7,500 per violation. The statute creates no private right of action under the ICDPA itself. Indiana Code: IC 24-15-10

The 30-day statutory cure process precedes a qualifying enforcement action. Indiana Code: IC 24-15-10-3

06 / PREPARATION

Connect the legal map to every tracking route.

Counsel decides the organization’s scope, the data and vendor classifications, and which notices and contracts are required. The technical team makes those decisions work in the browser and in downstream platforms.

Your legal and privacy team’s scope

  • Thresholds and exemptions
  • Sale, targeted-advertising and profiling classification
  • Sensitive data and children
  • Notices, requests, assessments and contracts
  • Organizational compliance and governance

Your technical team’s scope

  • Find cookies, scripts and platforms like Google Ads and Meta
  • Test direct opt-out and GPC behavior
  • Check hard-coded and Tag Manager paths
  • Implement approved suppression rules
  • Retest and record observable outcomes

A practical Indiana sequence

  1. Confirm coverage and exemptions.

  2. Map each tag to a purpose and recipient.

  3. Identify the flows covered by each opt-out.

  4. Pass the choice to every relevant script.

  5. Inspect network activity after submission.

  6. Fix and verify any mismatch.

07 / TECHNICAL VERIFICATION

How to document website tracking behavior.

Use separate browser sessions to compare the site’s initial behavior, its response to a direct opt-out, and its response to Global Privacy Control where relevant to your review. Record the page URL, test time, browser settings and exact choice made so the result can be reproduced.

Inspect cookies and network requests before and after each choice. Record which requests continue, their destinations and the controls involved. Browser evidence can help diagnose an implementation; it cannot establish statutory applicability, the legal purpose of every transfer or organization-wide compliance.

11 / SCOPE AND RESPONSIBILITY

A technical scan has defined limits.

Etalon is not a law firm and does not provide legal advice. A passing scan or certificate does not guarantee that an organization satisfies every legal obligation.

Technical testing records observable website behavior. Your legal and privacy team remains responsible for scope, exemptions, vendor classification, notices, requests, sensitive data, contracts and governance.

OPTIONAL SUPPORTING TOOL

Using Spectra in a technical review

Etalon Spectra compares network requests and cookies across isolated consent states to identify tracking that continues after a visitor opts out.

It can support the evidence-gathering process described in this guide. Findings describe tested website behavior and do not determine whether an organization complies with the law.
